What You’re Entitled to for Property Damage

Aside from damages related to personal injury, seeking compensation for property damage is critical to easing the burdens and financial strains victims and families can face after being involved in a car accident. Determining what you’re entitled to for property damage will depend on the facts of your case, but will generally consist of a few important elements:

  • Repairs – If your vehicle is considered repairable (typically when repair costs are less than 75% of the vehicle’s value), the at-fault driver’s auto insurance should cover the repairs.
  • Diminished Value – In addition to covering the costs of vehicle repairs (when a vehicle is repairable), at-fault drivers are also required to provide payment for diminished value. This means any decrease in the value of your vehicle due to it being involved in an accident. Motorists are typically entitled to diminished value payment when their vehicles are newer and/or when repair costs were more than 25% of the vehicle’s value.
  • Fair Market Value – When your vehicle is totaled, South Carolina law entitles you to recover the fair market value (FMV) of your vehicle. This generally means the value of your car at the time immediately prior to the accident. While appraising a vehicle to determine its FMV may seem like a straightforward matter, insurance companies may not always agree with the proposed value of a vehicle, and may attempt to pay less than what it is truly worth. This is why it becomes important to work with experienced attorneys who know how to communicate with insurance carriers and protect your rights.
  • Rental Car – Vehicle damage can cause tremendous strain when motorists no longer have a car to transport themselves to work, drop off and pick up children, and handle other essential tasks. As such, you are entitled to a rental car when your vehicle is being repaired, or from the date of the accident to the time the other driver’s insurance company makes an offer after your vehicle has been totaled. Sometimes, there can be difficulties when insurance companies won’t accept liability and provide you with a rental car, or when they say you may only be entitled to a certain amount for rental expenses (which may not cover the costs of renting a full-size SUV similar to the one you needed to transport your children). In these situations, it’s important to remember that you do have rights, and that the law requires insurance companies to treat you fairly. In the interim, it may be possible to get a rental car through your own collision coverage, or to pay for a rental vehicle out of pocket and be reimbursed later.
